1. Who We Are
Portunus is a technology platform operated by Rowe & Wren LLC, doing business as Portunus ("Portunus", "we", "us", "our").
Portunus provides software tools designed to assist users in organising and preparing information related to U.S. immigration pathways, including the E-2 Treaty Investor visa.
2. Acceptance of These Terms
By creating an account or accessing the platform, you agree to these Terms of Use and our Privacy Policy.
If you do not agree, you must not use the platform.
3. Nature of the Platform (No Legal Advice)
Portunus is not a law firm and does not provide legal advice.
All content, tools, eligibility assessments, dashboards, templates, business plans, forecasts, or outputs generated by the platform are provided:
- for informational and organisational purposes only
- not as legal advice
- not as a substitute for advice from a qualified immigration attorney
Use of the platform does not create an attorney-client relationship between you and Portunus.
4. No Guarantees
Portunus does not guarantee:
- visa approval or eligibility
- accuracy of eligibility assessments
- acceptance of any materials by U.S. embassies, consulates, or government agencies
- any particular immigration outcome
All immigration decisions are made solely by government authorities.
5. Free Account Scope
A free account may include access to:
- eligibility tools and questionnaires
- dashboards and summaries
- limited informational content
- other platform features designated as free
Portunus may modify, restrict, or discontinue free features at any time.
Paid services, where offered, are governed by separate service terms presented at the time of purchase.
6. User Responsibilities
You agree that:
- all information you provide is accurate and truthful
- you are responsible for reviewing all outputs before use or submission
- you will not rely on platform outputs as legal advice
- you will comply with all applicable laws and regulations
You remain solely responsible for your immigration decisions and submissions.
7. Third-Party Legal Services
Portunus may introduce or facilitate access to independent third-party immigration attorneys.
Where legal services are provided:
- those services are offered solely by the attorney
- any attorney-client relationship is between you and the attorney only
- Portunus does not provide legal advice and is not responsible for legal representation or outcomes
Separate agreements apply to attorney services.
8. Intellectual Property
The platform, software, branding, and underlying technology are owned by Portunus.
You retain ownership of your personal data and information you submit.
You grant Portunus a limited license to use your data solely to operate and improve the platform, in accordance with our Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by law:
- Portunus is not liable for indirect, incidental, consequential, or special damages
- Portunus's total liability for free account usage shall not exceed $100 USD
Some jurisdictions may limit these exclusions; in such cases, liability is limited to the fullest extent permitted.
10. Account Suspension or Termination
We may suspend or terminate your account if you:
- violate these Terms
- misuse the platform
- engage in fraudulent or unlawful conduct
You may stop using the platform at any time.
11. Changes to These Terms
We may update these Terms from time to time.
Continued use of the platform after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
