Process

How to apply for an E-2 visa in Sydney

Read this as a sequence, not a menu. Each step depends on the one before it.

  1. 01

    Complete the DS-160

Fill in the DS-160 nonimmigrant visa application online and keep the confirmation page. Every applicant needs their own, including dependants.

Consular Electronic Application Center(opens the official site in a new tab)

  2. 02

Create an account and pay the MRV fee

Set up an account on the visa appointment service and pay the machine-readable visa fee. This is where the registration is raised — you are not booking an interview yet.

Visa appointment service(opens the official site in a new tab)

  3. 03

    Submit the supporting documents

Upload the complete evidence package electronically, following the instructions given after the fee is paid.

U.S. Consulate General Sydney will not open a case for review until the DS-160, the fee and the documents are all in. Nothing is scheduled before that.

  4. 04

Wait for the review, then the invitation

The E-Visa Unit reviews cases against 9 FAM 402.9 in the order received, and may ask for more documents. When the review is finished you are emailed an invitation to book the interview.

  5. 05

    Attend the interview

Book through the appointment service once invited, and present your case at U.S. Consulate General Sydney. Bring the printed DS-160 confirmation — its barcode must match the number on your appointment account.

Attend within 90 days of the invitation. Miss that window and the registration has to be submitted again from the beginning.

Important Sydney instructions

  • Complete the "Applying for an E1/E2 Visa in Australia" form within three days of paying the visa fee.
  • Do not attach documents to the appointment scheduling request. The consulate emails you separate instructions for sending them.
  • Do not contact the consulate or schedule an appointment until you receive the email saying the application is approved for scheduling.
  • A company that applies and qualifies is registered automatically for five years. Later applicants from a registered company submit much less.
  • The post gives ten business days after the interview as normal processing.

Third-country nationals

Applying for an E-2 visa in Sydney as a third-country national

Sydney regularly processes E-2 applications from eligible third-country nationals, although acceptance and appointment availability can change.

A third-country national is someone who applies at a U.S. post outside their country of citizenship — for example, a treaty-country citizen who lives and works elsewhere. Consular practice now expects applicants to file where they hold citizenship or permanent residence, so filing elsewhere is the exception rather than the norm. Compare every post by how readily it takes outside applicants.

We rate this post 2 out of 3 for third-country processing, meaning it processes them as a matter of routine. That rating is our own reading of published guidance and applicant reports — it describes willingness to schedule an appointment, not your eligibility for approval, and it carries no official standing.

Policy at individual posts changes without much notice. Confirm the current position before you build a filing plan around itU.S. Consulate General Sydney(opens the official site in a new tab).

Australia runs an E-2 process with one short deadline near the start that catches people out: after paying the visa fee, you have three days to complete the "Applying for an E1/E2 Visa in Australia" form.

Everything after that is a waiting game you are told not to interrupt. The consulate emails you instructions for sending your documents, reads them, and contacts you when the case is ready for an interview. Until that email arrives you do not contact the consulate and you do not schedule an appointment.

The sequence, and where the deadline sits

The three-day window is the only hard deadline in the process and it runs from payment, not from readiness. Do not pay the fee until you are in a position to complete the form immediately afterwards.

  1. 01

Complete the DS-160 and note the ten-digit barcode number from the confirmation page.

  2. 02

Create a profile using a unique email address — each dependent needs their own.

  3. 03

    Pay the visa application fee.

  4. 04

Within three days of paying, complete the "Applying for an E1/E2 Visa in Australia" form. The consulate then emails you instructions for submitting your documents.

  5. 05

Wait. The consulate contacts you when the application is approved for scheduling.

  6. 06

Schedule the appointment from your profile, then attend.

Do not attach documents to the scheduling request

When the appointment scheduling request page appears, it will accept attachments. Do not use it for your E-2 evidence — the consulate is explicit that required documents are emailed separately, following the instructions it sends you at step four.

Documents uploaded in the wrong place are not documents the reviewing officer will see, and there is no error message to tell you so.

One detail worth double-checking

The DS-160 number generated by the CEAC website must match the number entered in the online application. A mismatch here is a silent failure of the kind that surfaces late, and it takes seconds to verify.

Every applicant also needs a unique email address on their profile, dependents included. A family sharing one address cannot complete the profile step.

Five-year company registration

When a company first applies and qualifies for an E-1 or E-2 visa, the consulate automatically registers it for five years. Once registered, later applicants from that company submit substantially less documentation, and Australia publishes a separate, shorter requirement list for them.

Five years is at the generous end — Copenhagen decides between 12, 36 and 60 months case by case. It makes the first Australian filing from a business a long-lived asset rather than a one-off cost.

What to bring to the interview

  • A copy of the DS-160 confirmation page
  • One recent photograph
  • Current passport and all old passports
  • The original visa fee payment receipt, if you paid over the counter
  • The appointment confirmation letter

Sydney or Melbourne

Both are consulates general working from the same mission-wide instructions, with the same three-day form deadline, the same document-first sequence and the same five-year registration. We score both a 2 for third-country nationals.

Nothing in the published process distinguishes them, so the choice is about travel and appointment availability on the day you look.

What an E-2 visa application costs at Sydney

There is no single total. The MRV fee is fixed and published, and it starts the three-day clock. Preparation costs vary with the case, and submission is electronic so there is no printing or courier expense.

Check the current published MRV fee before you pay — and be ready to file the form the same week.

How long an E-2 visa takes at Sydney

Three periods sit end to end. The consulate reviews your documents before you can book, so that review comes first. Appointment availability follows, and the Department of State publishes that figure by post. The mission then gives ten business days after the interview as normal processing.

Only the middle figure is published as a wait time, so it describes less than half the picture. Administrative processing, where it applies, sits outside all three.

What the E-2 is, and who qualifies from Australia

The E-2 is a nonimmigrant treaty investor visa open to nationals of countries holding a qualifying treaty of commerce with the United States, and Australia is one of those treaty countries. You must have invested, or be actively in the process of investing, a substantial amount of your own at-risk capital in a real and operating U.S. business that you will direct and develop.

The enterprise must be at least 50 percent owned by persons holding the treaty nationality, or controlled by a qualifying national. An Australian applicant’s own eligibility does not survive a non-treaty partner holding the majority stake.

Australia also has the E-3 visa, available to Australian nationals in specialty occupations, which is a different route with different requirements. If you are being employed rather than investing, that is usually the comparison worth making.

Questions

E-2 visa in Sydney: common questions

How do I submit my E-2 visa application to U.S. Consulate General Sydney?

Documents first, interview second. You complete the DS-160, pay the MRV fee through the appointment service, then submit the full evidence package electronically. U.S. Consulate General Sydney will not open the case for review until all three are done, and only invites you to book an interview once that review is complete. Employees of a company that is already registered are the exception — they book directly and submit nothing in advance.

Is there a page or file-size limit for E-2 visa applications at U.S. Consulate General Sydney?

U.S. Consulate General Sydney publishes no page or file-size limit for the E-2 package. Assemble it to the standard PDF binder structure with a table of contents and clearly labelled tabs, and keep it proportionate — a shorter, better-ordered package reads more easily than a long one.

Can third-country nationals apply for an E-2 visa at U.S. Consulate General Sydney?

Yes. U.S. Consulate General Sydney regularly processes E-2 applications from eligible third-country nationals. Acceptance and appointment availability change, so confirm the current position with the post before you build a filing plan around it.

How long does an E-2 visa take at U.S. Consulate General Sydney?

We do not publish an estimate for U.S. Consulate General Sydney, because a number invented for a page like this would be worse than none. travel.state.gov publishes current visa appointment wait times by post, and that is the figure to check. Total time is appointment availability plus any administrative processing after the interview. Book flights and shipping only once the visa is in your passport.

What should I bring to my E-2 visa interview at U.S. Consulate General Sydney?

Bring your passport, the DS-160 confirmation page, the MRV fee receipt, your appointment confirmation, and the originals behind your evidence — financial statements, business registration, lease and purchase agreements. Bring a printed copy of the package you uploaded, so you can refer to it during the interview. Expect questions about how you found the business, where the money came from, and how you will run it.
